Terms & Conditions

Welcome to Kissa. These Terms & Conditions ("Terms") govern your use of the Kissa mobile application ("App") and related services provided by Ushaar Hoomans Private Limited ("Company," "we," "our," or "us"). By downloading, installing, or using Kissa, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using Kissa, you confirm that you have read, understood, and agree to these Terms. If you are using the App on behalf of a minor, you represent that you are the parent or legal guardian and accept these Terms on their behalf.

2. Description of Service

Kissa is an audio streaming platform that provides bedtime stories, lullabies, and other audio content primarily in Malayalam, designed for children. The App offers both free and premium subscription-based content.

3. Eligibility

• You must be at least 18 years of age to create an account on Kissa.
• Children under 13 years of age may only use the App under the supervision of a parent or legal guardian who has created an account.
• By creating an account, you represent that the information you provide is accurate and complete.

4. Account Registration

• Accounts are created using phone number verification via OTP (One-Time Password) through Firebase Authentication.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

5. Profiles

Kissa supports multiple profiles within a single account, allowing families to create separate profiles for different listeners. Each profile may have its own listening history and preferences. You are responsible for all activity across all profiles under your account.

6. Subscription & Billing

• Free Trial: New users may be eligible for a free trial period. The duration and availability of free trials are determined at our discretion and may change without notice.
• Subscription Plans: Premium features require a paid subscription, billed on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Payment Processing: All payments are processed through the Apple App Store or Google Play Store. We do not directly collect or store your payment information.
• Price Changes: We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing period following notice.

7. Refunds

Refund requests are handled by the respective app store through which you purchased your subscription:

• Apple App Store: Refunds are subject to Apple's refund policy.
• Google Play Store: Refunds are subject to Google Play's refund policy.

We are unable to process refunds directly. Please contact the relevant app store for refund requests.

8. Intellectual Property

All content available on Kissa, including but not limited to audio stories, illustrations, music, text, graphics, logos, and software, is the property of Ushaar Hoomans Private Limited or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the App without our prior written consent.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the App, other accounts, or our systems.
• Copy, record, download, or redistribute any content from the App except as expressly permitted.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use automated tools, bots, or scrapers to access the App or its content.
• Interfere with or disrupt the operation of the App or its servers.

10. Privacy

Your use of Kissa is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

11. Content Availability

We strive to provide a diverse and growing library of audio content. However, we do not guarantee the availability of any specific titles or content. We reserve the right to add, remove, or modify content at any time without prior notice.

12. Termination

• You may delete your account at any time by contacting us at dev@hoomans.dev.
• We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to other users, us, or third parties.
• Upon termination, your right to use the App ceases immediately. Any active subscriptions should be cancelled through the respective app store to avoid further charges.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

• Kissa is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• In no event shall Ushaar Hoomans Private Limited be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.
• Our total liability for any claim arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India.

15. Changes to Terms

We may update these Terms from time to time. Any significant changes will be communicated through the App or other reasonable means. Your continued use of Kissa after such changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
